Using the site

• You must be at least 18, or have the permission of a parent or guardian, to place an order.
• You must give accurate delivery and contact details. We are not responsible for a parcel sent to an address you typed wrongly.
• Do not scrape, resell, mirror or systematically copy the catalogue, the images or the descriptions.
• Do not attempt to interfere with the site, its security, or other people using it.

Where we sell

• We accept orders for delivery to Australia, the United States, Canada and the United Kingdom.
• An order for delivery anywhere else will be cancelled and refunded in full.
• You are responsible for knowing whether a product you order can legally be imported into your own country.

Prices, currency and tax

• Prices are set in AUD. The Australian dollar price includes 10% Australian GST.
• You can view and pay in AUD, USD, CAD or GBP. Conversion uses a rate baked into the site at build time with a stated margin, and the converted figure shown is the figure charged.
• No United States sales tax, Canadian GST or HST, or United Kingdom VAT is added at checkout.
• Import duties and taxes on a delivery outside Australia are set and collected by your own customs authority, are not included in the price, and are payable by you. See the shipping page.
• A struck out price is the recommended retail price published by the brand, not a price we previously charged.
• Prices can change without notice. The price that applies to your order is the price shown when you place it.
• Delivery is charged separately unless your order qualifies for free standard delivery.

Orders and acceptance

Your order is an offer to buy. A contract forms only when we send you an email confirming dispatch, or in this build, when we confirm the order and the payment arrangement.

• We can decline or cancel an order before dispatch, and we will refund you in full if we do.
• Common reasons: the item is out of stock, the price or the description was wrong, the order looks fraudulent, or the delivery address is one we cannot serve.
• We can limit quantities per customer on high demand items.

Payment

• Card payment is taken at checkout through Stripe, on a payment page hosted by Stripe. We never see, handle or store your card number.
• You are charged in the currency displayed on the site when you check out. The amount is checked against the amount quoted before you are sent to the payment page, and the order is abandoned rather than charged if the two disagree.
• Your bank may add its own foreign transaction fee if the currency you pay in is not the currency of your card. That fee is between you and your bank and we never see it.
• An order is not accepted until payment is authorised.

Product information

• Product descriptions, ingredient lists and images come from the brands and their distributors. We pass them through and we do not rewrite them.
• Colours on a screen are approximate. A shade on your monitor is not a colour match promise.
• Ingredient lists and formulations change. Always read the pack in front of you, especially if you have an allergy.
• Nothing on this site is medical advice or a treatment recommendation.

Delivery, title and risk

• Delivery timing and cost are set out on the shipping page and form part of these terms.
• Delivery estimates are estimates, not guarantees, and time is not of the essence.
• Title and risk in the goods pass to you on delivery to the address you gave us.
• If a carrier leaves a parcel at an address on your instruction, that is delivery.
• On a delivery outside Australia you are the importer. Duty, import tax and any carrier clearance or brokerage fee are yours, not ours.
• If you refuse a parcel or fail to pay an import charge and the parcel comes back to us, we refund the goods less the outbound and return freight we actually paid.

Returns

The returns policy forms part of these terms. In short: 30 days on unopened goods for change of mind, no change of mind returns on opened cosmetics for hygiene reasons, and full rights preserved when a product is faulty.

Consumer rights

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law. Where we are permitted to limit our liability, we limit it to replacing the goods, supplying equivalent goods, or refunding what you paid for them.

If you are buying from the United States, Canada or the United Kingdom, the mandatory consumer protections of the country and state or province where you live apply to you in the same way, and nothing in these terms is intended to remove them. The returns page summarises each of them.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your use of a product in a way the brand did not intend. Always patch test, follow the instructions on the pack, and stop using anything that irritates your skin.

Intellectual property

• Brand names, logos, product images and product copy belong to their owners and are used here to sell their goods.
• The design, layout and code of this site belong to us.
• Nothing here transfers any right in a brand to you.

How we handle your information is set out in the privacy policy, which forms part of these terms.

Changes to these terms

We can update these terms. The version that applies to your order is the version published when you placed it. Material changes will be dated at the top of this page.

Governing law and jurisdiction

The seller is HAYAITI HOLDINGS LTD, a corporation incorporated in Ontario, Canada, with its registered address at 4 Robert Speck Parkway, Suite 1200, Mississauga ON L4Z 1S1, Canada.

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply in it, and the courts of Ontario have jurisdiction over any dispute arising out of them.

That does not take away the consumer protections of the country where you live. A choice of law clause cannot override the mandatory consumer law of your own jurisdiction, and we are not trying to. If you are in Australia, the United States or the United Kingdom, you keep every right your own law gives you, including any right it gives you to bring a claim closer to home.
